Evergreen Go Green Raffle 2008

By entering the Evergreen Community Charter School’s Go Green Raffle contest (this “Raffle“), persons purchasing and holding a valid ticket or a chance to win a prize (“Ticket Buyer”) agrees that Ticket Buyer has read the contest rules listed below (“Official Rules”) and acknowledges to have understood them and agrees to be bound by them. Ticket Buyer acknowledges the adequacy and sufficiency of the consideration given by Evergreen Community Charger School (“ECCS“) in connection with this raffle. Tickets for a single chance shall have a cost of TWENTY-FIVE DOLLARS, $25 (the “Chance Price”).

    1. The prize is a Solar Hot Water System. FLS Energy will guarantee the delivery and installation of a new Solar Hot Water System including 2 - 4x8 AET panels, hot water tank and associated piping, within a 1.5 hour radius of Asheville, North Carolina – valued at $8,000; this raffle is subject to that guarantee. Winner may choose $5000 instead of Solar Hot Water System.
    2. The winner will be selected by means of a drawing, executed with a reputable spinning canister. ECCS reserves the right to change the drawing method based on availability of drawing apparatus.
    3. Drawing of prize will take place on May 31, 2008 as part of the school’s Graduation Ceremony.
    4. Winner need not be present to win prize.
    5. Prize must be claimed within 30 days of notification.  Should a prize not be claimed within the specified time period, it shall be forfeited to the benefit of Evergreen Community Charter School (ECCS).
    6. All entrants must be 18 years of age or older to enter. 
    7. Winners are subject to all raffle procedures, restrictions, rules, state and local laws and regulations. Rules are subject to change.
    8. Winners are responsible for any and all taxes due. ECCS shall not have any obligation to pay any tax which becomes due as a result of the award of prizes under this raffle.
    9. Proceeds from this raffle shall benefit ECCS.
    10. Prize will be awarded provided the number of tickets sold equals at least 300 tickets with proceeds delivered to ECCS. ECCS shall have the discretion to recall this raffle and refund tickets accordingly, should ticket sales fall below 300 tickets. Or the ECCS Board of Directors may in their absolute discretion change or adjust the prize amount should ticket sales fall below 300 tickets.
    11. Upon issuance of a raffle ticket, all sales are final and non-refundable.
    12. Raffle tickets will be sequentially numbered and accounted for.
    13. The odds of winning are dependent on the number of valid entries.  In no event shall the number of entries exceed 1200 chances or tickets (the “Maximum Number of Chances”). ECCS reserves the right to terminate ticket sales at any time prior to the final drawing date.
    14. Ticket Buyer should consult with a financial advisor to determine tax consequences of entering or winning prize. Ticket Buyer releases ECCS from any liability associated with potential tax treatment resulting from this raffle.
    15. If Ticket Buyer is a winner, by entering, Ticket Buyer authorizes the use of Ticket Buyer’s name for promotional purposes. 
    16. Winners accepting prizes agree that all prizes are awarded on the condition that ECCS will have no liability whatsoever for any injuries, losses, or damages of any kind resulting from acceptance, possession, or use of any prizes.
    17. To qualify for any prize drawing, ECCS must receive Ticket Buyers complete and paid entry before the drawing in order for that entrant to be eligible to participate in the drawing.
    18. Void where prohibited or restricted by law.
    19. In the event of any dispute, during the drawing or thereafter, the decision of the ECCS Board Executive Committee, or their authorized agent shall be final. No person shall be deemed an authorized agent unless said authorization is appointed by the ECCS Board.
    20. Ticket Buyer agrees if any form of payment is returned unpaid or is not electronically authorized any ticket issued pursuant to such a draft shall automatically become void and the entry shall be removed and said chance resold. ECCS may at any time prior to the drawing date limit acceptance of ticket sales to cash payments or the equivalent thereto.
    21. The Executive Committee of the Board and their household members are not eligible to participate in the raffle.
